The Golden State allows adults of 21 and older to legally buy and possess CBD. Being the most liberal state in America – it is not surprising that CBD is completely legal here, on top of the fact that Californians are the strongest supporters of cannabis legalization.
CBD product can be bought pretty much anywhere in California, due to the lack of restrictions, especially when compared to other states such as Louisiana.
Even though California allows the manufacturing and sales of cannabis products, and their definition of CBD is consistent with the federal definition, there is one thing people should be aware of – CBD cannot be added to food products.
This is what a letter issued by the Attorney General’s Office says on the matter:
“Although California currently allows the manufacturing and sales of cannabis products (including edibles), the use of industrial hemp as the source of CBD to be added to food products is prohibited. Until the FDA rules that industrial hemp-derived CBD oil and CBD products can be used as a food or California makes a determination that they are safe to use for human and animal consumption, CBD products are not an approved food, food ingredient, food additive, or dietary supplement.”
Is Cannabis legal in California?
Cannabis is legal to consume for medical or recreational purposes.
California was the first state in America to legalize medical marijuana when it passed the Compassionate Use Act of 1996. And 20 years later, the state passed the Adult Use of Marijuana Act, legalizing cannabis for recreational purposes.

- Anorexia
- Arthritis
- Cachexia, or wasting syndrome
- Cancer
- Chronic pain
- Glaucoma
- Migraine
- Persistent muscle spasms
- Seizures
- Severe nausea
- Any other chronic or persistent medical condition that limits the ability of the patient to conduct one or more major life activities
Are there any penalties for CBD in California?
It is illegal to consume, smoke, eat or vape cannabis in public.
Conclusion:
Hemp-derived and marijuana-derived CBD is legal in California, without a prescription of a doctor. As well as recreational and medical use of Cannabis.
