While an increased number of states have legalized medical marijuana, Kentucky resisted the pressure for longer than most. However, in March 2014, industrial hemp was removed from its definition of marijuana. CBD was also available as long as a patient could prove that a Kentucky public university-affiliated physician prescribed it in written form. At present, you don’t need a prescription to buy CBD, if it has a content of less than 0.3% THC.

Currently the sale or trafficking of fewer than eight ounces of cannabis is a Class A misdemeanor for a first offense punishable by up to one year in prison and a $500 fine. Products with trace amounts of other cannabinoids, including THC are prohibited. Possession of up to eight ounces of marijuana can lead to 45 days in jail and $250 fine.

Hemp-derived CBD is legal for every individual as long as it contains 0.3% or less THC. Cannabis for medical and personal use is illegal in Kentucky.
