In 2015, state lawmakers passed a measure that established a legal difference between marijuana plants and industrial hemp plants. The law defined marijuana as plants containing more than 0.3% THC by weight and industrial hemp as plants with less than 0.3% THC by weight. It was also now legal to grow, possess, sell, or buy industrial hemp in the state. As per this law, a person must register with the state before legally planting, growing, harvesting, or processing industrial hemp or any products from these plants.

In 2018 this law was expanded, which allowed industrial hemp grown or cultivated under the state’s hemp program to be sold, distributed, transported, marketed, and processed both in-state or outside of the state.

Currently, in Maryland, it’s legal to purchase, possess and consume CBD and CBD products as long as they are derived from plants that meet the legal definition of industrial hemp.

Qualifying conditions:

  • Anorexia
  • Cachexia, or wasting syndrome
  • Conditions resulting in a patient receiving hospice or palliative care
  • Glaucoma
  • Post-traumatic stress disorder (PTSD)
  • Seizures
  • Severe or chronic pain
  • Severe nausea
  • Severe or persistent muscle spasms
  • Other chronic medical conditions (1) that are severe, (2) for which other treatments have been ineffective, and (3) whose symptoms can be expected to be relieved by medical cannabis.

Are there any penalties for using cannabis in Maryland?

Consuming cannabis in public, in a parked or moving motor vehicle for either drivers or passengers, or on private property where smoking is forbidden, is against the law. Riding a bicycle under the influence of cannabis also is illegal.
