CBD derived from hemp became formally legalized in January 2019 following the enactment of the Michigan Industrial Hemp Research and Development Act. That means industrial hemp with less than 0.3% THC concentration by dry weight, and legalizes hemp-derived CBD and CBD products.
While hemp-derived CBD is legal, it may not be added in food or beverages or sold as a dietary supplement. This rule also applied to other states such as Louisiana and Georgia.
CBD derived from other cannabis varieties is also legal for all Michigan residents. CBD products produced from marijuana will not be regulated as marijuana if the THC content is below 0.3%. Products derived from industrial hemp with a THC concentration above 0.3% are classified as marijuana. There aren’t any specified limits for CBD derived from cannabis.
Is cannabis legal in Michigan?
Cannabis became legal for medical use in 2008. Michigan also legalized cannabis in November 2018.

Qualifying conditions:
- Alzheimer’s disease
- Amyotrophic lateral sclerosis (ALS), or Lou Gehrig’s disease
- Cancer
- Crohn’s disease
- Glaucoma
- Hepatitis C
- HIV/AIDS
- Nail-patella syndrome
The MMMP also reserves medical cannabis for chronic or debilitating conditions, or their treatments, that produce one or more of the following:
- Cachexia, or wasting syndrome
- Seizures, including those characteristic of epilepsy
- Severe and chronic pain
- Severe nausea
- Severe and persistent muscle spasms, including but not limited to those characteristic of multiple sclerosis
To be able to qualify for a medical marijuana card, you must be diagnosed by a physician as having a debilitating medical condition. Technically, CBD oil is not a FDA approved drug and therefore cannot be prescribed by doctors.
Are there any penalties for using cannabis in Michigan?
If you possess more than 2,5oz up to 5oz in public you have to pay a $500 fine. More than 5oz for first offense, will also be charged with a $500 fine.
Conclusion:
CBD with 0.3% THC is legal for every individual in Michigan. Cannabis is also legal for recreational and medical use, however different than with hemp-derived CBD there are possession limits.
