Mississippi is one of the three states (Idaho and D.C.) in the US that chose not to take advantage of the Farm bill and industrial hemp program. Therefore, the state of Mississippi has one of the most restrictive laws regarding CBD and all things cannabis.
Currently, Mississippi allows CBD with low THC content for medical use to patients with qualifying conditions.
In 2014, it became possible for patients who suffer from severe epileptic conditions to use and possess CBD oil that contains at least 15% CBD and no more than 0.5% THC by weight. Patients can obtain state approved, low-THC cannabis by doctor’s recommendation and obtain it from the University of Mississippi’s Medical Center’s Department of Pharmacy Services. All CBD products consumed by the Mississippi residents must be grown by the University of Mississippi’s National Center for Natural Products Research.
Possession of any amount of CBD with more than 2.5 milligrams of THC per milliliter is punishable by Mississippi law. So, if you decide to use CBD in Mississippi, make sure you only use brands that offer third-party lab reports. This information enables you to determine how much CBD and THC are in each product.

- Severe pain that has not responded to previously prescribed medication or surgical measures or for which other treatment options produced serious side effects, constant or severe nausea, moderate to severe vomiting, seizures, or severe, persistent muscle spasms
- Moderate to severe chronic pain.
- Post-traumatic stress disorder (PTSD)
Are there any penalties for using cannabis in Mississippi?
The offense for possession of fewer than 30 grams of cannabis is a fine of $250, while subsequent offenses are as misdemeanors than can earn up to six months in prison and a $1000 fine. Mississippi police are likely to arrest for possession if a product looks like marijuana.
Conclusion:
CBD is legal in Mississippi, but only if it contains very little THC. Cannabis is illegal for recreational use and medical marijuana has very harsh rules. Physicians in Mississippi aren’t allowed to prescribe medical marijuanna or CBD. However, they are allowed to recommend it as long as it’s for epilepsy.
