In Missouri, it’s legal to buy CBD produced from industrial hemp plants. The Missouri General Assembly then passed a measure in 2018 to remove hemp from marijuana definition.

In July 2019, Missouri legalized medical marijuana. To legally use CBD oil in Missouri, you should be approved by the MHERP to participate as a patient. To be able to participate in this program you must be diagnosed with intractable epilepsy.

But it’s not impossible to buy CBD when you aren’t diagnosed with epilepsy. Some retailers have CBD Hemp products they offer, even they can still be prosecuted for selling CBD. Doctors in Missouri are not permitted to prescribe hemp CBD products to their patients. They are, however, allowed to recommend CBD oil if they think it can be beneficial for the patients.

In 2019, Missouri started accepting licensed dispensary facility applications, hence patients or licensed caregivers can legally obtain and possess cannabis. Adult-use or recreational marijuana is still illegal in Missouri.

  • Amyotrophic lateral sclerosis, or Lou Gehrig’s disease 
  • Autism
  • Cachexia, or wasting syndrome
  • Cancer
  • Crohn’s disease
  • Epilepsy 
  • Glaucoma
  • Hepatitis C
  • HIV/AIDS
  • Huntington’s disease
  • Inflammatory bowel disease
  • Intractable migraines
  • Neuropathy
  • Post-traumatic stress disorder (PTSD) and other debilitating psychiatric disorders
  • Sickle cell disease
  • Terminal illness
  • Any chronic condition treated with a medication that could lead to dependence
  • Chronic conditions causing severe, persistent pain or muscle spasms including:
    • Multiple sclerosis 
    • Parkinson’s disease
    • Seizures
    • Tourette’s syndrome

Are there any penalties for using CBD in Missouri?

If a patient possesses an amount of marijuana between the possessor’s legal limit, the patient can be fined $200 and have their medical identification card taken away. Non-patients who possess up to 10g of cannabis have to pay a $500 fine. Second offense will be charged with one year imprisonment and $2000 fine.

Conclusion:

CBD is legal in Missouri, however only for medicinal purposes. Cannabis is illegal for recreational use.
