In 2019 the Nebraska Hemp Farming Act was signed. Under both the Farm Bill and the Nebraska Hemp Farming Act, CBD oil derived from a cannabis or hemp plant which contains less than 0.3% THC is legal. However, you are only allowed to use THC or CBD- based medicine if you are a patient in the Medical CBD Pilot Study. If you are arrested in possession or using CBD oil, law enforcement will treat an investigation of CBD oil in the same manner as they would a narcotics investigation.
Is Cannabis legal in Nebraska?
The possession of cannabis, for personal and medical use is illegal in Nebraska. The state does not have a medical marijuana program. Nebraska mainly limited legal marijuana-based CBD to study participants.

- HIV/AIDS
- Epileptic seizures
- PTSD
- ALS
- Tourette’s syndrome
- Hepatitis C
- Crohn’s disease
- Ulcerative colitis
- Huntington’s disease
- Parkinson’s disease
- Autism with frequent or serious self-injurious or aggressive behavior
- Spinal cord injury or disease
- Severe or chronic pain lasting longer than two weeks that is not adequately managed by non-opioid medications
- Severe and persistent muscle spasms caused by multiple sclerosis, spinal cord injury, or muscular dystrophy
- A terminal illness with less than a year to live
- Or a serious medical condition, or the treatment of a serious medical condition, that causes severe nausea or cachexia.
Are there any penalties for using CBD in Nebraska?
The possession of marijuana, for personal and medical use is charged just like the illegal possession of CBD.
A first offense of possession of 1 ounce or less of cannabis is treated as an infraction with a $300 fine. For second and third offenses, possession of 1 ounce or less results in a $500 fine with five and seven days jail time. Doctors with a license to work in Nebraska aren’t allowed to prescribe CBD or cannabis-derived products. However, they can support patients with intractable epilepsy by giving them a certificate to use the FDA approved drug containing CBD.
Conclusion:
CBD is only legal for patients in the Medical CBD Pilot Study. Cannabis is illegal for recreational use.
