Hemp-derived CBD is legal in New York, and is widely available in retail stores as well as online. A recent regulation from October 2020 now states that CBD can even be added to food and beverages as long as none of them contains neither alcohol nor tobacco.
In June 2019, a comprehensive regulatory framework surrounding the licensing, manufacturing, sale and use of hemp and CBD was approved by the New York State. The 2018 Farm Bill reclassified hemp as an agricultural commodity and made its cultivation federally legal. This distinction in federal law effectively legalized CBD that is derived from cannabis with less than 0.3% THC, as long as it has been cultivated according to federal and state regulations.

Medical marijuana patients can legally possess a thirty day supply of cannabis-derived CBD products. Cannabis remains illegal for adult use in New York, although marijuana possession was discriminated against to an extent in August 2019.

Possession of up to 2 ounces is a violation, subject to a maximum fine of $200.
