CBD products derived from industrial hemp are legal in Ohio since 2019. Ohio’s bill set the standard for hemp versus marijuana at a 0.3% THC cutoff. In the state CBD is legal for use in food, dietary supplements, cosmetics, and personal care products, among other products. There are no possession limits for hemp-derived CBD, however CBD products that contain more than 0.3% THC remain illegal to sell, possess, and consume unless you are registered under Ohio’s medical marijuana program.

Is Cannabis legal in Ohio?

Medical cannabis was legalized in 2016, but the control program wasn’t fully established until 2018. Residents of Ohio can buy marijuana-derived CBD oil if they can provide a written recommendation from a doctor. However, cannabis for personal use is illegal in Ohio. State voters of Ohio attempted to pass a bill in November 2015 that would have made recreational weed legal but was unsuccessful.

  • Pain that is either chronic and severe, or intractable
  • Parkinson’s disease
  • Post-traumatic stress disorder (PTSD)
  • Sickle cell disease
  • Spinal cord disease or injury
  • Tourette’s syndrome
  • Traumatic brain injury
  • Ulcerative colitis

Are there any penalties for using Cannabis in Ohio?

Now, adults who are caught in possession of 100 to 200 grams are subject to a misdemeanor and a fine of $150 dollars. Possession of more than 200 grams is punishable by a fine of $2,500 and time in jail.

Conclusion:

CBD is legal in Ohio. Ohio has a medical marijuana program, however, that only means that patients are allowed to consume CBD with more than 0.3% THC. Just like in North Carolina, recreational use of cannabis is illegal in Ohio.
