Texas removed CBD with 0.3% THC or less from its Schedule I controlled substances list in July of 2019 with the passage of House Bill 1325. Access to CBD in Texas requires patients go through a strict medical process that is available only to people with severe illnesses. The Texas Compassionate Use Act legalized CBD with 0.5% THC or less for patients with Autism, Intractable epilepsy, seizure disorders. Possession of CBD is legal in Texas, as long as it falls under the 0.3% THC threshold and there is no need for a doctor’s prescription.

Are there any penalties for using CBD in Texas?
If you are caught with CBD that contains more than 0.3% THC, you could face charges of a sentence of 180 days to two years and a $10,000 fine. Recreational use of cannabis is illegal in Texas. Those caught with up to 4 ounces of marijuana are charged with a year in jail and a fine up to $4,000. Possessing more than 4 ounces can lead to 180 days in jail to up to 99 years and a fine of $10,000 to $50,000 depending on the possession amount.
Conclusion:
Hemp-derived CBD is legal, as long as it contains 0.3% or less of THC. Cannabis is illegal for medical and recreational use. Patients with qualifying conditions are allowed to consume CBD with 0.5% THC.
